Terms of Service
By using Lumiqa, you agree to these terms. If you disagree, please don't use the service.
Your account
You are responsible for keeping your credentials safe and for activity on your workspace.
Acceptable use
Don't upload illegal content, malware, or content you don't own rights to. We may remove content and suspend workspaces that violate these rules.
Billing
Paid subscriptions are charged monthly via Stripe. Trials are free for 14 days. Cancel anytime from Settings → Billing.
EU Right of Withdrawal
EU consumers have a 14-day right of withdrawal for digital services under EU Directive 2011/83/EU. By starting the trial and using Lumiqa, you acknowledge that the digital service begins immediately and you expressly waive the 14-day withdrawal right per Article 16(m) of Directive 2011/83/EU. This does not affect your statutory rights as a consumer.
Data Processing (GDPR Article 28)
For all video content, project files, comments, and other materials you upload to Lumiqa, you (the customer) act as the data controller and Lumiqa acts as the data processor on your behalf, in accordance with Article 28 of the GDPR (Regulation (EU) 2016/679). We process your content solely to provide the service, following your documented instructions, and apply appropriate technical and organizational measures. A Data Processing Agreement (DPA) is available on request at privacy@lumiqa.io.
Intellectual Property
You retain full ownership of all content you upload or create within Lumiqa. We do not claim any intellectual property rights over your content. By using the service, you grant us a limited license to host, display, and deliver your content solely for the purpose of operating the platform.
We keep backups for up to 30 days after account closure and then delete them.
Service Availability
We strive to keep Lumiqa available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. There is no SLA guarantee for the free tier.
Limitation of Liability
Lumiqa is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the fees you have paid in the preceding 3 months.
Termination
You may close your account at any time from your workspace settings. We may suspend or terminate your access if you violate these terms. Upon termination, your data will be retained for 30 days to allow export, after which it will be permanently deleted.
Governing Law
These terms are governed by the laws of Italy, where AB Tools is registered. EU consumers retain rights under their home jurisdiction's consumer protection laws and may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
